Notice is hereby given by the Council of the Borough of Riegelsville that at its Regular Meeting on Wednesday, July 13, 2022 at 7:00 p.m. at the Borough Hall, Riegelsville, Pennsylvania, it shall consider the passage of “Ordinance # 245 – An Ordinance Governing Municipal Management and Maintenance of On-Lot Sewage Disposal Facilities in the Borough of Riegelsville, Bucks County, PA.” A full copy of the proposed ordinance may be examined without charge at the Borough Hall, the office of this newspaper or the Law Library at the Bucks County Court House during normal business hours, or may be obtained upon request for a charge not greater than the cost thereof. The following is a summary of the ordinance that will be presented for adoption at the meeting:
Section 1 designates the short title the ordinance as being the “Riegelsville Borough On-Lot Sewage Disposal System (OLDS) Management Program”; introduces the background and basis of the ordinance; states is purpose; and, upon its adoption, expressly rescinds and replace Riegelsville Borough Ordinance No. 227 in its entirety.
Section 2 defines Sixty (60) terms as used in the ordinance and further includes and incorporates by reference all definitions included in Act 537 and the Clean Stream Law (as amended).
Section 3 sets forth the applicability of the ordinance to existing and new on-lot sewage disposal systems.
Section 4 contains the permit requirements with respect to the installation, rehabilitation, construction or alteration of an on-lot sewage disposal system.
Section 5 sets forth how and in what manner inspections of on-lot sewage disposal systems shall be conducted.
Section 6 regulates the operation of on-lot sewage disposal systems.
Section 7 regulates the maintenance of on-lot sewage disposal systems.
Section 8A governs the process by which a malfunctioning on-lot sewage disposal system shall be rehabilitated, repaired, replaced or otherwise corrected.
Section 8B regulates the permitting, installation and use of a holding tank in the event that such is necessary.
Section 9 authorizes the Borough to perform or contract to have performed, at the owner’s expense, corrective work in the event the owner fails to do so and, if necessary, lien the property for same.
Section 10A addresses the disposal of septage.
Section 10B regulates the licensing of any businesses proposing to offer wastewater management services (pumping/hauling) in the Borough.
Section 11 sets forth how the ordinance will be administered by the Borough.
Section 12 provides for a right and process of appeal from decisions of the Borough or its authorized agents under the ordinance.
Section 13 imposes penalties for any property owner and/or person who has violated or permitted the violation of the provisions of this ordinance.
Section 14 is a repealer section.
Section 15 is a savings clause.
Section 16 describes liability, or lack thereof, arising from the issuance of permits under the ordinance.
